§ 1 Scope & provider

These Terms & Conditions govern use of wikey.cc and spread.site (the “Platform” or “Service”) between the operator (see Imprint, “we”) and users (“you”). The wikey®IMS project is operated by a private individual on a voluntary, non-commercial basis; it is not intended as a commercial service and generates no income. By using the Platform you accept these Terms.

§ 2 Subject of the service

wikey.cc / spread.site is an Intermedial Messaging Service: a communication, media and hosting platform where users create, publish and share multimedia messages (“spreads”) and generate QR codes, flyers and NFC artifacts. It also offers a classifieds board (“marketplace”) and gamification (“EVE”). All features are free and provided without intention of profit. There is no entitlement to particular features or continuous availability. Participation is voluntary; there is no contractual duty to use or contribute.

§ 3 Registration & account

Core functions require a free account and truthful details. Keep credentials secret; you are liable for activity under your account. As a rule, one account is allowed per person; multiple/fake accounts used to manipulate EVE or reach are prohibited. You may delete your account at any time; we may suspend or delete accounts for violations.

§ 4 EVE — nature, not a financial product

“EVE” (internally “energy” / “digital energy”) are purely virtual in-platform reward and loyalty points with a gamification character, reflecting activity and resonance. They are neither legal tender nor money, e-money, a payment service, financial instrument, security or investment, nor cryptocurrency or a tradable crypto-asset. They exist only as a database value, not on a blockchain; have no monetary value, cannot be paid out or redeemed for real money, and cannot be transferred outside intended platform mechanics. There is no payout claim, interest, yield, profit promise or vested right; EVE may be adjusted, reset or discontinued at any time. As a closed, non-monetary loyalty programme (limited network), wikey.cc is not a licensable financial or payment service and is not supervised by the FMA. “Wallet” and “smart contract” are metaphors and denote no financial/blockchain function.

§ 5 Marketplace (classifieds)

The marketplace is solely an intermediary board for offers and requests between users. wikey.cc does not become a contracting party; contracts arise exclusively between users. wikey.cc processes no real-money payments and is not an escrow agent. Users alone are liable for the accuracy, legality, quality and fulfilment of listings.

§ 6 User content & rights

You retain rights to your content and grant us a non-exclusive, worldwide, royalty-free licence to store, display and distribute it within the Service (including QR/flyer/offline export). You warrant that you hold all required rights to uploaded content. We may remove unlawful content or content violating these Terms.

§ 7 Prohibited use

Prohibited are unlawful, abusive, discriminatory, violent or youth-endangering content; spam, manipulation of EVE/votes/scans, automated mass requests and security attacks; infringement of third-party copyright, trademark or personality rights; and presenting EVE to third parties as money, an investment or a tradable asset.

§ 8 Availability & changes

We aim for high availability but owe no uninterrupted access. We may evolve, limit or discontinue features. Material changes to these Terms will be announced; continued use constitutes acceptance.

§ 9 Liability

We are liable without limitation for intent, gross negligence and under mandatory law. For slight negligence we are liable only for breach of essential contractual duties, limited to foreseeable, typical damage. Liability for user-generated content, transactions between users and the non-existent “value” of EVE is excluded.

§ 10 Data protection

We process personal data under the GDPR solely to provide the Service. Details on the controller and contact are in the Imprint.

§ 11 Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules remain unaffected. If a provision is invalid, the remainder of the contract stays in force. Place of performance and jurisdiction follow statutory rules.
